Trademark VS Copyright

This is an important subject because everyone should want to protect their work or Business name.

What is a Copyright?

Copyright definition - the exclusive legal right, given to an originator or an assignee to print, publish, perform, film, or record literary, artistic, or musical material, and to authorize others to do the same.

Copyright protection basically gives you the creator the legal right to sell and distribute work that was created by you.

What would I copyright?

  • Books
  • Logos
  • T-shirt Designs
  • Photos
  • Drawings
  • Writings
  • Graphic Designs
  • Music
  • Videos
  • software

Who has Copyright protection?

The Originator or creator of the work has Copyright protection against infringement.

What is the difference between a person and a company?

If the work is created by a company the copyright normally expires after 95 years of first use. If an individual created the work it usually expires 70 years after that person dies.

What is a Trademark?

Trademark definition - a symbol, word, or words legally registered or established by use as representing a company or product.

A Trademark protects your business from infringement or damage of reputation by another company.

What would I Trademark?

  • Name
  • Word
  • Phrase
  • Symbol
  • Design
  • Logo

Trademark applications are not cheap. Before you apply you will want to do thorough research. If you apply for a Trademark and it is found that someone else is already using it you risk losing your money.
